6. OTHER IMPORTANT PROVISIONS. Customer agrees to be bound by all provisions of the Copyright Act of 1976, as amended, or its successor statutes, and agrees not to avail itself of any right of sovereign immunity to which it might otherwise be entitled. The term "Software" includes the Software as maintained by Licensor and any enhancements provided by Licensor hereunder. Licensor shall have the right to have any warranty or maintenance services performed by its suppliers or agents rather than by itself. If any part of this Agreement is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in effect. This Agreement constitutes the entire agreement between the parties, terminates any prior agreements as to its subject matter, can be modified only by an instrument in writing signed by the party against whom enforcement of the same is sought, and shall be governed by Massachusetts law. This agreement shall inure to the benefit of Licensor's successor and assigns. Notices must be in writing and delivered by one party to the other party at its address appearing herein or to such other address as to which such party notifies the other party in writing. Licensor shall not be liable for any delay or failure to deliver for reasons beyond its reasonable control. No terms or conditions in a purchase order, whether or not accepted by Licensor, shall add to or modify this Agreement. The Software may not be used in connection with Customer's performance of services for the United States Government or any agency or subdivision thereof or for any contractor or subcontractor of the United States Government or any agency or subdivision thereof, to the extent that such use would result in a loss of any of Licensor's rights in the Software to the United States Government or any agency or subdivision thereof.
Customer agrees to all the foregoing terms and conditions.
